relating to the provision of information to a party in an eviction | ||
suit regarding the party's right to appeal a judgment and | ||
procedures for appeal. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 24, Property Code, is amended by adding | ||
Section 24.005105 to read as follows: | ||
Sec. 24.005105. STATEMENT OF PARTIES' RIGHT TO APPEAL | ||
JUDGMENT OF JUSTICE COURT. At the same time that the justice court | ||
renders a judgment in a suit under this chapter, the justice court | ||
shall provide a statement to each party to the suit: | ||
(1) giving notice of the party's right to appeal the | ||
judgment, if any; | ||
(2) explaining, as applicable, the procedure for | ||
appeal with respect to: | ||
(A) the payment of a deposit; or | ||
(B) the filing of an appeal bond or a statement of | ||
inability to pay; and | ||
(3) stating that, on request of the party, the court | ||
will provide a form for a statement of inability to pay. | ||
SECTION 2. Section 24.005105, Property Code, as added by | ||
this Act, applies only to a judgment of a justice court in an | ||
eviction suit rendered on or after the effective date of this Act, | ||
regardless of whether the suit was filed before, on, or after the | ||
effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2023. |
