A BILL TO BE ENTITLED
 
AN ACT
  relating to the provision of information regarding certain public
  assistance programs by public schools.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 38, Education Code, is
  amended by adding Section 38.042 to read as follows:
         Sec. 38.042.  INFORMATION REGARDING CERTAIN PUBLIC
  ASSISTANCE PROGRAMS. (a) On a student's enrollment in, transfer
  out of, or withdrawal from a school district, the district shall
  provide to the student and the student's parent information
  regarding the eligibility requirements for public assistance
  programs, including:
               (1)  the medical assistance program under Chapter 32,
  Human Resources Code;
               (2)  the child health plan program under Chapter 62,
  Health and Safety Code; and
               (3)  the supplemental nutrition assistance program
  under Chapter 33, Human Resources Code.
         (b)  The agency, in coordination with the Health and Human
  Services Commission, shall prepare and make available to school
  districts a model form for the information required to be provided
  under Subsection (a).
         (c)  In providing the information required under Subsection
  (a), the school district shall ensure that the student's parent
  signs a form acknowledging receipt of the information.
         SECTION 2.  This Act applies beginning with the 2021-2022
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
