A BILL TO BE ENTITLED
AN ACT
relating to the name of the Burnet County Municipal Utility
District No. 1.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The heading to Chapter 7913, Special District
Local Laws Code, is amended to read as follows:
CHAPTER 7913. HIGHWAY 71 [BURNET COUNTY] MUNICIPAL UTILITY
DISTRICT [NO. 1]
SECTION 2. Section 7913.001(4), Special District Local Laws
Code, is amended to read as follows:
(4) "District" means the Highway 71 [Burnet County]
Municipal Utility District [No. 1].
SECTION 3. (a) The legislature validates and confirms the
creation of the Highway 71 Municipal Utility District and all acts
and proceedings of the district under that name or as the Burnet
County Municipal Utility District No. 1 that were taken before the
effective date of this Act, including all elections conducted by
the district.
(b) Subsection (a) of this section does not apply to any
matter that on the effective date of this Act:
(1) is involved in litigation if the litigation
ultimately results in the matter being held invalid by a final
judgment of a court; or
(2) has been held invalid by a final judgment of a
court.
SECTION 4. A reference in law to the Burnet County Municipal
Utility District No. 1 means the Highway 71 Municipal Utility
District.
SECTION 5. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2017.
