A BILL TO BE ENTITLED
 
AN ACT
  relating to the satisfaction of a condition of community
  supervision requiring performance of community service.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 16(f), Article 42.12, Code of Criminal
  Procedure, is amended to read as follows:
         (f)  In lieu of requiring a defendant to work a specified
  number of hours at a community service project or projects under
  Subsection (a), the judge may order a defendant to make a specified
  donation to:
               (1)  a nonprofit food bank or food pantry in the
  community in which the defendant resides; or
               (2)  an organization selected by the defendant that is
  tax-exempt under Section 501(c)(3), Internal Revenue Code of 1986,
  and is approved by the judge.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
