practice nurses and physician assistants under the Medicaid | ||
program. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 32, Human Resources Code, | ||
is amended by adding Section 32.0426 to read as follows: | ||
Sec. 32.0426. REIMBURSEMENT FOR SERVICES PROVIDED BY | ||
ADVANCED PRACTICE NURSES AND PHYSICIAN ASSISTANTS. (a) In this | ||
section: | ||
(1) "Advanced practice nurse" has the meaning assigned | ||
by Section 301.152, Occupations Code. | ||
(2) "National provider identifier" means the national | ||
provider identifier required under Section 1128J(e), Social | ||
Security Act (42 U.S.C. Section 1320a-7k(e)). | ||
(3) "Physician assistant" means a person who holds a | ||
license issued under Chapter 204, Occupations Code. | ||
(b) If an advanced practice nurse or a physician assistant | ||
provides a service to a recipient under the medical assistance | ||
program at the direction or under the supervision of another | ||
provider and the advanced practice nurse or physician assistant, as | ||
applicable, is the primary provider of the service: | ||
(1) the name and associated national provider | ||
identifier of the advanced practice nurse or physician assistant, | ||
as applicable, must be included as the rendering provider on any | ||
claim for reimbursement submitted by a provider; and | ||
(2) the department may reimburse the claim only at the | ||
provider level established by rule for an advanced practice nurse | ||
or physician assistant, as applicable. | ||
(c) The executive commissioner of the Health and Human | ||
Services Commission may adopt rules necessary to implement this | ||
section. | ||
SECTION 2. If before implementing any provision of this Act | ||
a state agency determines that a waiver or authorization from a | ||
federal agency is necessary for implementation of that provision, | ||
the agency affected by the provision shall request the waiver or | ||
authorization and may delay implementing that provision until the | ||
waiver or authorization is granted. | ||
SECTION 3. This Act takes effect September 1, 2013. |
