| relating to reimbursement for services provided by advanced | ||
| practice nurses and physician assistants under the Medicaid | ||
| program. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 32, Human Resources Code, | ||
| is amended by adding Section 32.0426 to read as follows: | ||
| Sec. 32.0426. REIMBURSEMENT FOR SERVICES PROVIDED BY | ||
| ADVANCED PRACTICE NURSES AND PHYSICIAN ASSISTANTS. (a) In this | ||
| section: | ||
| (1) "Advanced practice nurse" has the meaning assigned | ||
| by Section 301.152, Occupations Code. | ||
| (2) "National provider identifier" means the national | ||
| provider identifier required under Section 1128J(e), Social | ||
| Security Act (42 U.S.C. Section 1320a-7k(e)). | ||
| (3) "Physician assistant" means a person who holds a | ||
| license issued under Chapter 204, Occupations Code. | ||
| (b) If an advanced practice nurse or a physician assistant | ||
| provides a service to a recipient under the medical assistance | ||
| program at the direction or under the supervision of another | ||
| provider and the advanced practice nurse or physician assistant, as | ||
| applicable, is the primary provider of the service: | ||
| (1) the name and associated national provider | ||
| identifier of the advanced practice nurse or physician assistant, | ||
| as applicable, must be included as the rendering provider on any | ||
| claim for reimbursement submitted by a provider; and | ||
| (2) the department may reimburse the claim only at the | ||
| provider level established by rule for an advanced practice nurse | ||
| or physician assistant, as applicable. | ||
| (c) The executive commissioner of the Health and Human | ||
| Services Commission may adopt rules necessary to implement this | ||
| section. | ||
| SECTION 2. If before implementing any provision of this Act | ||
| a state agency determines that a waiver or authorization from a | ||
| federal agency is necessary for implementation of that provision, | ||
| the agency affected by the provision shall request the waiver or | ||
| authorization and may delay implementing that provision until the | ||
| waiver or authorization is granted. | ||
| SECTION 3. This Act takes effect September 1, 2013. | ||
