A BILL TO BE ENTITLED
 
AN ACT
  relating to the retention of good conduct time by an inmate whose
  release on parole or to mandatory supervision is revoked.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 498.004(b), Government Code, as amended
  by Chapters 249 (S.B. 44) and 321 (H.B. 2162), Acts of the 74th
  Legislature, Regular Session, 1995, is reenacted and amended to
  read as follows:
         (b)  On the revocation of parole or mandatory supervision of
  an inmate, the department may not forfeit any of the [inmate
  forfeits all] good conduct time [previously] accrued by the inmate
  before the inmate was released on parole or to mandatory
  supervision. On return to the department, [institutional division]
  the inmate may accrue additional [new] good conduct time for
  subsequent time served in the department [division. The department
  may not restore good conduct time forfeited on a revocation].
         SECTION 2.  The change in law made by this Act applies only
  to a revocation of the parole or mandatory supervision of a person
  on or after the effective date of this Act. A revocation made
  before that date is governed by the law in effect on the date the
  revocation occurred, and the former law is continued in effect for
  that purpose.
         SECTION 3.  This Act takes effect September 1, 2011.
