| relating to the exclusion of students not lawfully present in the | ||
| United States from consideration for purposes of the indicators of | ||
| achievement under the public school accountability system. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 39.053, Education Code, is amended by | ||
| adding Subsection (c-5) to read as follows: | ||
| (c-5) A student not lawfully present in the United States | ||
| may not be included in evaluating school district and campus | ||
| performance on the achievement indicators adopted under Subsection | ||
| (c) and may be considered only as necessary to comply with | ||
| applicable federal accountability reporting requirements. | ||
| SECTION 2. This Act applies beginning with the 2023-2024 | ||
| school year. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
