relating to the exclusion of students not lawfully present in the | ||
United States from consideration for purposes of the indicators of | ||
achievement under the public school accountability system. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 39.053, Education Code, is amended by | ||
adding Subsection (c-5) to read as follows: | ||
(c-5) A student not lawfully present in the United States | ||
may not be included in evaluating school district and campus | ||
performance on the achievement indicators adopted under Subsection | ||
(c) and may be considered only as necessary to comply with | ||
applicable federal accountability reporting requirements. | ||
SECTION 2. This Act applies beginning with the 2023-2024 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
