BE IT RESOLVED by the Senate of the State of Texas, 88th | ||
Legislature, Regular Session, 2023, That Senate Rule 12.03 be | ||
suspended in part as provided by Senate Rule 12.08 to enable the | ||
conference committee appointed to resolve the differences on Senate | ||
Bill 12 (the authority to regulate sexually oriented performances | ||
and to restricting those performances on the premises of a | ||
commercial enterprise, on public property, or in the presence of an | ||
individual younger than 18 years of age; authorizing a civil | ||
penalty; creating a criminal offense) to consider and take action | ||
on the following matter: | ||
Senate Rule 12.03(4) is suspended to permit the committee to | ||
add text on a matter not included in either the house or senate | ||
version of the bill in proposed SECTION 3 of the bill, by adding | ||
Section 43.28(a)(1)(E), Penal Code, to read as follows: | ||
(E) the exhibition of sexual gesticulations | ||
using accessories or prosthetics that exaggerate male or female | ||
sexual characteristics | ||
Explanation: The change is necessary to add additional | ||
conduct to the definition of sexual conduct. |
