Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 22.1-57.3:1.3 as follows:
§22.1-57.3:1.3. School board for the City of Lynchburg; staggered terms in the event of election.
In the event that the school board for the City of Lynchburg is required to be elected by popular vote in accordance with the provisions of subsection A of §22.1-57.3, such school board shall be elected as provided in §22.1-57.3, except that all members shall be elected for four-year terms and the school board elections shall alternate biennially between the election of one member from each of the four ward districts and the election of one member from each of the three at-large districts to ensure staggered terms.
2. That notwithstanding the provisions of §22.1-57.3:1.3 of the Code of Virginia, as created by this act, in the event that the school board for the City of Lynchburg is required to be elected by popular vote in accordance with the provisions of subsection A of §22.1-57.3 of the Code of Virginia, at the immediately succeeding general election, either (i) one member from each of the three at-large districts shall be elected to two-year terms and one member from each of the four ward districts shall be elected to four-year terms if the members of the Lynchburg City Council from each of the four ward districts are elected at such general election or (ii) one member from each of the four ward districts shall be elected to two-year terms and one member from each of the three at-large districts shall be elected to four-year terms if the members of the Lynchburg City Council from each of the three at-large districts are elected at such general election. The then-current appointed school board members shall continue to serve until their successors have been elected and qualified. At each general election subsequent to such general election, the members of the school board for the City of Lynchburg shall be elected in accordance with the provisions of §22.1-57.3:1.3 of the Code of Virginia, as created by this act.
