A BILL to amend the Code of Virginia by adding a section numbered 8.01-42.6, relating to personal injury action against health care provider; certain defenses prohibited.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-42.6 as follows:
§ 8.01-42.6. Personal injury action against health care provider; prohibited defense.
No defendant health care provider shall assert medical malpractice as a defense in any civil action for personal injury against such health care provider arising from conduct prohibited by Article 7 (§ 18.2-61 et seq.) of Chapter 4 of Title 18.2, whether or not the health care provider has been charged or convicted of the alleged violation.
For the purposes of this section, "health care provider" means the same as that term is defined in § 8.01-581.1.
