Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 19.2-303.6 as follows:

§19.2-303.6. Time-served credit for pretrial home/electronic incarceration.

A circuit or district court, when imposing a sentence of incarceration upon a person convicted of a criminal offense, may allow the person convicted credit for time served prior to trial under home/electronic incarceration authorized under §19.2-123 and shall set forth in the sentencing order whether or not the convicted person is to receive such credit.
