Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 3.2-5116.1 as follows:

§3.2-5116.1. Certified food protection manager.

Notwithstanding any other provision of law, no establishment that only sells prepared food shall be required to have a certified food protection manager as defined in §35.1-1 on site during all hours of operation.
