Be it enacted by the General Assembly of Virginia: 1. That §18.2-460 of the Code of Virginia is amended and reenacted as follows: §18.2-460. Obstructing justice; penalty. A. If any person without just cause knowingly obstructs a
judge, magistrate, justice, juror, attorney for the Commonwealth, witness, B. Except as provided in subsection C, any person who, by
threats or force, knowingly attempts to intimidate or impede a judge,
magistrate, justice, juror, attorney for the Commonwealth, witness, C. If any person by threats of bodily harm or force knowingly
attempts to intimidate or impede a judge, magistrate, justice, juror, attorney
for the Commonwealth, witness, clerk or deputy clerk of any court, any
law-enforcement officer D. Any person who knowingly and willfully makes any materially false statement or representation to a law-enforcement officer or an animal control officer employed pursuant to §3.2-6555 who is in the course of conducting an investigation of a crime by another is guilty of a Class 1 misdemeanor. 2. That the provisions of this act may result in a net increase in periods of imprisonment or commitment. Pursuant to §30-19.1:4, the estimated amount of the necessary appropriation cannot be determined for periods of imprisonment in state adult correctional facilities; therefore, Chapter 665 of the Acts of Assembly of 2015 requires the Virginia Criminal Sentencing Commission to assign a minimum fiscal impact of $50,000. Pursuant to §30-19.1:4, the estimated amount of the necessary appropriation cannot be determined for periods of commitment to the custody of the Department of Juvenile Justice. |
