A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 1 of Title 10.1 a section numbered 10.1-104.5, relating to nonpoint source pollution; civil penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 1 of Title 10.1 a section numbered 10.1-104.5 as follows:

§10.1-104.5. Application of pesticides and fertilizers; penalty.

No commercial provider of lawn care or landscaping services shall apply pesticides, fertilizers, or other source of toxic or nutrient nonpoint source pollution onto streets, driveways, sidewalks, curbs, and gutters, whether in solid or liquid form. Any person in violation of this section may be assessed a civil penalty upon the second offense not to exceed $250. All civil penalties imposed under this section shall be deposited into the Virginia Water Quality Improvement Fund established in §10.1-2128.
