SENATE BILL NO. 736
AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the Senate Committee on General Laws and Technology
on February 8, 2016)

A BILL to address local ordinances concerning the installation or use of landscape cover materials until regulations have been approved as part of the Statewide Fire Prevention Code.

Be it enacted by the General Assembly of Virginia:

1. §1. Notwithstanding any provision of law, general or special, any ordinance in effect and any ordinance adopted by the governing body of the City of Harrisonburg shall not include in any local fire prevention regulations the following: (i) a requirement that an owner of real property who has an occupancy permit issued by the City use specific landscape cover materials or retrofit existing landscape cover materials at such property or (ii) a requirement that an owner of real property use specific landscape cover materials on buildings to be constructed until such regulation has been approved as part of the Statewide Fire Prevention Code adopted by the Board of Housing and Community Development.
