A BILL to amend the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §29-3B-11, relating to the adoption of the 2008 National Electric Code; providing for adoption of updates of the code every three years; and requiring the State Fire Marshal to notify the public of adopted changes in that code.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §29-3B-11, to read as follows:
ARTICLE 3B. SUPERVISION OF ELECTRICIANS.

§29-3B-11. Promulgation of rules adopting National Electric Code.
(a) The State Fire Marshal shall propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a of this code to adopt the National Electric Code as the current electric code for the state. The rules shall provide that every three years when a new National Electric Code is in effect, the new electric code will automatically be brought up before the Legislature for review and consideration for adoption.
(b) The State Fire Marshal shall notify the public of any changes in the electric code when a new National Electric Code is amended and approved by the Legislature.




NOTE: The purpose of this bill is to provide for adoption of the 2008 National Electric Code and updates of the code every three years. The bill also requires the State Fire Marshal to notify the public of adopted changes in that code.
