A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5-10-22l, relating to prohibiting a public employee retirant from being reemployed by the state within one year of retiring.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §5-10-22l, to read as follows:
ARTICLE 10. WEST VIRGINIA PUBLIC EMPLOYEES RETIREMENT ACT.
§5-10-22l. Retirement; one year prohibition of reemployment.
Notwithstanding any other provision in this code to the contrary, upon a member’s retirement, as provided in this article, he or she may not be employed in any manner, including by reemployment, contract or subcontract, by the state for a period of one year.
NOTE: The purpose of this bill is to prohibit a public employee retirant from being reemployed by the state within one year of retiring.
