HOUSE BILL 2440

 

 

AN ACT

 

Establishing a demonstration project to reduce the use of the state motor vehicle fleet and increase the use of transportation network, vehicle for hire companies, fleet management companies, rental car companies and other public‑private partnerships.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  State motor vehicle fleet reduction demonstration project; transportation network, vehicle for hire companies, fleet management companies, rental car companies and other public‑private partnerships; annual report; exemption; delayed repeal; definitions

A.  The department of administration shall establish a demonstration project to reduce the use of the state motor vehicle fleet as described in section 41-803, Arizona Revised Statutes, and increase the use of transportation network companies, vehicle for hire companies, fleet management companies, rental car companies and other public‑private partnerships to provide transportation for state officers and employees.  The department of administration shall determine the most cost-effective method of travel by motor vehicle for all employees of state agencies, boards, commissions or other entities within the executive department of state government.  The department of administration shall use the determination made pursuant to this subsection to establish the maximum amounts for travel reimbursement pursuant to section 38-624, Arizona Revised Statutes.

B.  The department of administration and the departments and agencies that are excluded from participation in the state motor vehicle fleet pursuant to section 41-803, subsection E, Arizona Revised Statutes, shall participate in the demonstration project and collectively reduce the overall inventory of light motor vehicles in the state motor vehicle fleets by up to ten percent for each of the fiscal years 2018‑2019 and 2019‑2020 and increase the use of transportation network companies, vehicle for hire companies, fleet management companies, rental car companies and other public‑private partnerships to provide transportation for state officers and employees.

C.  Notwithstanding subsection B of this section, the department of child safety shall complete a study of the department's efforts to reduce the number of light motor vehicles that are in the department's state motor vehicle fleet and to reduce the amount of reimbursement for mileage paid to state employees in fiscal years 2018-2019 and 2019-2020, including efforts made in fiscal years 2016-2017 and 2017-2018.  The department of child safety shall evaluate the use of transportation network companies, vehicle for hire companies, fleet management companies, rental car companies and other public-private partnerships to provide transportation for state officers and employees.  On or before December 1, 2019 and December 1, 2020, the department of child safety shall submit a report on the results of the study to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

D.  On or before December 1, 2019 and December 1, 2020, the department of administration shall submit a report on the results of the demonstration project, including findings and recommendations, to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

E.  This section does not apply to community college districts.

F.  This section is repealed from and after December 31, 2020.

G.  For the purposes of this section:

1.  "Light motor vehicle" means a motor vehicle that has a gross vehicle weight of eight thousand five hundred pounds or less.

2.  "Transportation network company" has the same meaning prescribed in section 28‑9551, Arizona Revised Statutes.

3.  "Vehicle for hire company" has the same meaning prescribed in section 28‑9501, Arizona Revised Statutes.
