AN ACT
Amending title 28, chapter 2, article 2, Arizona Revised Statutes, by adding section 28‑339; making an appropriation; relating to highway user revenues.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 28, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 28-339, to read:
28-339. Establish and maintain ledger; reallocations or transfers of highway user revenues
A. The department shall establish and maintain a ledger that provides a detailed accounting of all reallocations or transfers of monies from the Arizona highway user revenue fund that were made by the legislature but were not authorized by chapter 18, article 2 of this title at the time the reallocation or transfer of the monies occurred. the ledger shall:
1. Include all reallocations or transfers from January 1, 2000 through January 1, 2012 as well as all subsequent reallocations or transfers made by the legislature.
2. Specify how the monies would have been allocated under the distribution formula prescribed in chapter 18, article 2 of this title to cities, towns, counties and the state highway fund if the reallocations or transfers had not occurred.
B. For the purposes of subsection A of this section, the accounting for the reallocations or transfers shall include monies from the Arizona highway user revenue fund that were used to fund the department of public safety and the motor vehicle division of the department of transportation, monies from the state highway fund that were used to fund the department of public safety in excess of the amount specified in section 28‑6537 and vehicle license tax revenues collected pursuant to chapter 16, article 3 of this title for distribution to the state highway fund pursuant to section 28‑6538, subsection A, paragraph 1 that were transferred to the state general fund.
C. The legislature shall consider budgeting repayments of monies accounted for pursuant to this section from excess general fund monies to the department to make proportional payments against the ledger. Any payments made against the ledger shall be done solely at the discretion of the legislature based on funding availability.
D. Proportional payments against the ledger shall be calculated by adding the total amount of the ledger and dividing by the amount of monies payable to each jurisdiction or fund, resulting in a percentage. The percentage is used to calculate each jurisdiction's or fund's portion of the payment as set aside in the budget by the legislature. The department shall record all payments and balance the ledger.
Sec. 2. Appropriation; department of transportation; transfer; distribution
A. The sum of $20,000,000 is appropriated from the state general fund in fiscal year 2012-2013 to the department of transportation for proportional payments against the ledger consistent with the provisions of section 28‑339, Arizona Revised Statutes, as added by this act.
B. The department of transportation shall transfer any payment against the ledger that requires distribution to the cities, towns and counties to the state treasurer for distribution accordingly.
