BILL NUMBER: AB 1253 AMENDED BILL TEXT AMENDED IN ASSEMBLY JANUARY 4, 2012 INTRODUCED BY Assembly Member Davis FEBRUARY 18, 2011 An act to amend Section 29064 of the Government Code, relating topupil safetycounties . LEGISLATIVE COUNSEL'S DIGEST AB 1253, as amended, Davis.Pupil safety: bullying.Counties: recommended budget. Existing law requires the board of supervisors of a county to consider and approve a recommended budget, including any necessary revisions to the recommended budget, on or before June 30 of each year. Existing law requires the board of supervisors to conduct a public hearing on the recommended budget, and to adopt a budget on or before October 2 of each year. This bill would authorize the board to make revisions to the recommended budget until the board adopts a budget. The bill would require any revision to the recommended budget after the start of the public hearing to be made only if the revision is proposed in writing, and submitted to the clerk of the board prior to the close of the public hearing, or to be adopted by a vote of 4/5 of the board.Existing law, the Interagency School Safety Demonstration Act of 1985, defines bullying as one or more acts of sexual harassment, hate violence, or intentional harassment, threats, or intimidation, directed against school district personnel or pupils, committed by a pupil or group of pupils. Under existing law, bullying, including bullying committed by means of an electronic act, as defined, is a ground on which suspension or expulsion may be based.This bill would express the intent of the Legislature to enact legislation that would make it easier for pupils and their parents or guardians to report incidents of bullying.Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 29064 of the Government Code is amended to read: 29064. (a) On or before June 30 of each year the board, by formal action, shall approve the recommended budget, including the revisions it deems necessary for the purpose of having authority to spend until the budget is adopted. (b) (1) Except as provided in paragraph (2), the board may make revisions to the recommended budget until the budget is adopted pursuant to Article 4 (commencing with Section 29080). (2) A revision to the recommended budget after the start of the public hearing held pursuant to Article 4 (commencing with Section 29080) shall be made only if the revision is proposed in writing and filed with the clerk of the board prior to the close of the public hearing, or approved by a four-fifths vote of the board after the close of the hearing.SECTION 1.It is the intent of the Legislature to enact legislation that would make it easier for pupils and their parents or guardians to report incidents of bullying.
