An act to add Section 60902 to the Education Code, relating to education data.

AB 776, as amended, Kalra.
Education data: pupil identifiers: early childhood education programs.
Existing law establishes the California Longitudinal Pupil Achievement Data System, which is maintained by the State Department of Education and consists of pupil data regarding demographics, program participation, enrollment, and statewide assessments. Existing law requires a local educational agency to retain individual pupil records for pupils who take certain state assessments, including, among other records, a unique pupil identification number, as provided.
Existing law requires the department to establish a process by which local educational agencies issue, maintain, and report information using the unique statewide pupil identifier, referenced above, for state and federally funded center-based childcare and development programs, as provided.
This bill would require the department,
in consultation with the California Health and Human Services Agency, no later than July 1, 2020, January 1, 2021, to establish a process by which local educational agencies may assign a unique statewide pupil identifier for pupils enrolled in early childhood education programs under their purview that are early childhood education information for children enrolled in state or federally funded center-based childcare and development programs, and would require local educational agencies to submit those pupil identifiers to

The bill would require the process established by the department to include a process for a local educational agency to issue and submit a unique statewide pupil identifier to the department and maintain it on behalf of an applicant or contracting agency, as defined, that is not a local educational agency and that is operating a state or federally funded childcare and development program within the county in the jurisdiction of the local educational agency. The bill would require the department to provide all necessary technical support to local educational agencies for the
issuance, submission, and maintenance of the unique statewide pupil identifiers. The bill would authorize a local educational agency to request a statewide pupil identifier for children enrolled in early childhood education programs under their purview that are state or federally funded childcare and development programs and would require those pupil identifiers to be submitted to the California Longitudinal Pupil Achievement Data System. The bill would require a local educational agency that requests statewide pupil identifiers to maintain the pupil identifiers as required by the department on behalf of an applicant or contracting agency, as defined, that is not a local educational agency and that is operating a state or federally funded childcare and development program within the county in the jurisdiction of the local educational agency.

The people of the State of California do enact as follows:
SECTION 1.
Section 60902 is added to the Education Code, to read:60902.
(a) It is the intent of the Legislature that the California Longitudinal Pupil Achievement Data System contain early childhood education data to improve the quality of instruction and support services for(1) To help provide educators and parents with the tools, reports, and assistance needed to inform instruction and learning.
(2) To support
continuous programmatic improvement and create greater equity among all early childhood education programs to help inform instructional strategies and educational support services and to address the readiness gap that pupils children may demonstrate upon enrollment in kindergarten.
(3) If the data is used to determine funding for early childhood education programs, it should be used to ensure that all programs have the resources to benefit the children they serve and are funded equitably and fairly. serve.
Use of the data should not result in programs losing funding or being penalized based on programmatic or pupil-level child-level performance.
(4) To support a an aligned system of continuous learning through early childhood education and into the K–12 system.
(b) (1) No later than July 1, 2020, the department

(3)The department shall provide all necessary technical support to local educational agencies for the issuance, submission, and maintenance of unique statewide pupil identifiers pursuant to this subdivision.
(c) (1) A local educational agency may request statewide pupil identifiers for children enrolled in early childhood education
programs under their purview that are state or federally funded childcare and development programs, including, but not limited to, those that meet the definition in subdivision (i) of Section 8208, and shall submit those pupil identifiers to the California Longitudinal Pupil Achievement Data System, as referenced in paragraph (3) of subdivision (e) of Section 60900.
(2) A local educational agency that requests statewide pupil identifiers pursuant to paragraph (1) shall maintain the pupil identifiers as required by the department on behalf of an applicant or contracting agency, as that term is defined in subdivision (c) of Section 8208, that is not a local educational agency and that is operating a state or federally funded childcare and development program, including, but not limited to, one that meets the definition in subdivision (i) of Section 8208, within the county in the jurisdiction of the local educational agency.
(c)
(d) This section shall not limit the authority of the department to conduct administrative and fiscal oversight of programs pursuant to the Childcare and Development Services Act (Chapter 2 (commencing with Section 8200) of Part 6 of Division 1 of Title 1).
