BILL NUMBER: SB 169 INTRODUCED BILL TEXT INTRODUCED BY Senator Gaines FEBRUARY 5, 2015 An act to amend Section 12288 of the Elections Code, relating to elections. LEGISLATIVE COUNSEL'S DIGEST SB 169, as introduced, Gaines. Elections: polling places. Existing law requires an elections official to divide a jurisdiction into precincts and publish, not less than 1 week before the election, the list of the polling places designated for each election precinct. Existing law prohibits a place where the primary purpose of the establishment is the sale and dispensation of alcoholic beverages from being used as a polling place. This bill will make technical, nonsubstantive changes to the latter provision. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 12288 of the Elections Code is amended to read: 12288. A place where the primary purpose of the establishment is the sale and dispensation of alcoholic beveragesmayshall not be used as a polling place. A polling placemayshall not be connected by a door, window, or other opening withanya place whereanyan alcoholic beverage is sold or dispensed while the polls are open.
