AN ACT REQUIRING THE COMMISSIONER OF TRANSPORTATION TO ATTEND CERTAIN PUBLIC HEARINGS CONCERNING RAILROAD CROSSINGS AT GRADE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2011) The Commissioner of Transportation, or a designee of the commissioner, shall attend any public hearing concerning the safety and condition of a railroad crossing at grade upon receipt by the commissioner of a petition that requests the commissioner to attend such hearing and is signed by twenty-five or more electors of the municipality in which the crossing at grade is located.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To require the Commissioner of Transportation or said commissioner's designee to attend certain public hearings concerning railroad crossings at grade.
