ENROLLED 2023 Legislature CS for SB 190 2023190er 1 2 An act relating to interscholastic extracurricular 3 activities; amending s. 1002.20, F.S.; authorizing 4 charter school students and Florida Virtual School 5 full-time students to participate in extracurricular 6 activities at a private school under certain 7 circumstances; amending s. 1002.33, F.S.; authorizing 8 charter school students to participate in 9 interscholastic extracurricular activities at a 10 private school under certain circumstances; amending 11 s. 1006.15, F.S.; authorizing charter school students 12 and Florida Virtual School full-time program students 13 to participate in interscholastic extracurricular 14 activities at a private school under certain 15 circumstances; providing an effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. Paragraphs (c) and (d) of subsection (18) of 20 section 1002.20, Florida Statutes, are amended to read: 21 1002.20 K-12 student and parent rights.—Parents of public 22 school students must receive accurate and timely information 23 regarding their child’s academic progress and must be informed 24 of ways they can help their child to succeed in school. K-12 25 students and their parents are afforded numerous statutory 26 rights including, but not limited to, the following: 27 (18) EXTRACURRICULAR ACTIVITIES.—In accordance with the 28 provisions of s. 1006.15: 29 (c) Charter school students.—Charter school students who 30 meet specified academic and conduct requirements are eligible to 31 participate in extracurricular activities at the public school 32 to which the student would be assigned or could choose to attend 33 according to district school board policies, or may develop an 34 agreement to participate at a private school, unless such 35 activity is provided by the student’s charter school. 36 (d) Florida Virtual School full-time students.—Florida 37 Virtual School full-time students who meet specified academic 38 and conduct requirements are eligible to participate in 39 extracurricular activities at the public school to which the 40 student would be assigned or could choose to attend according to 41 district school board policies, or may develop an agreement to 42 participate at a private school. 43 Section 2. Subsection (11) of section 1002.33, Florida 44 Statutes, is amended to read: 45 1002.33 Charter schools.— 46 (11) PARTICIPATION IN INTERSCHOLASTIC EXTRACURRICULAR 47 ACTIVITIES.—A charter school student is eligible to participate 48 in an interscholastic extracurricular activity at the public 49 school to which the student would be otherwise assigned to 50 attend, or may develop an agreement to participate at a private 51 school, pursuant to s. 1006.15(3)(d). 52 Section 3. Paragraphs (d) and (e) of subsection (3) of 53 section 1006.15, Florida Statutes, are amended to read: 54 1006.15 Student standards for participation in 55 interscholastic and intrascholastic extracurricular student 56 activities; regulation.— 57 (3) 58 (d) An individual charter school student pursuant to s. 59 1002.33 is eligible to participate at the public school to which 60 the student would be assigned according to district school board 61 attendance area policies or which the student could attend, or 62 may develop an agreement to participate at a private school, in 63 any interscholastic extracurricular activity of that school, 64 unless such activity is provided by the student’s charter 65 school, if the following conditions are met: 66 1. The charter school student must meet the requirements of 67 the charter school education program as determined by the 68 charter school governing board. 69 2. During the period of participation at a school, the 70 charter school student must demonstrate educational progress as 71 required in paragraph (b). 72 3. The charter school student must meet the same residency 73 requirements as other students in the school at which he or she 74 participates. 75 4. The charter school student must meet the same standards 76 of acceptance, behavior, and performance that are required of 77 other students in extracurricular activities. 78 5. The charter school student must register with the school 79 his or her intent to participate in interscholastic 80 extracurricular activities as a representative of the school 81 before participation. A charter school student must be able to 82 participate in curricular activities if that is a requirement 83 for an extracurricular activity. 84 6. A student who transfers from a charter school program to 85 a traditional public school before or during the first grading 86 period of the school year is academically eligible to 87 participate in interscholastic extracurricular activities during 88 the first grading period if the student has a successful 89 evaluation from the previous school year, pursuant to 90 subparagraph 2. 91 7. Any public school or private school student who has been 92 unable to maintain academic eligibility for participation in 93 interscholastic extracurricular activities is ineligible to 94 participate in such activities as a charter school student until 95 the student has successfully completed one grading period in a 96 charter school pursuant to subparagraph 2. to become eligible to 97 participate as a charter school student. 98 (e) A student of the Florida Virtual School full-time 99 program may participate in any interscholastic extracurricular 100 activity at the public school to which the student would be 101 assigned according to district school board attendance area 102 policies or which the student could choose to attend pursuant to 103 s. 1002.31, or may develop an agreement to participate at a 104 private school, if the student: 105 1. During the period of participation in the 106 interscholastic extracurricular activity, meets the requirements 107 in paragraph (a). 108 2. Meets any additional requirements as determined by the 109 board of trustees of the Florida Virtual School. 110 3. Meets the same residency requirements as other students 111 in the school at which he or she participates. 112 4. Meets the same standards of acceptance, behavior, and 113 performance that are required of other students in 114 extracurricular activities. 115 5. Registers his or her intent to participate in 116 interscholastic extracurricular activities with the school 117 before participation. A Florida Virtual school student must be 118 able to participate in curricular activities if that is a 119 requirement for an extracurricular activity. 120 Section 4. This act shall take effect July 1, 2023.
