    2         An act relating to newborn screening; amending s.
    3         383.14, F.S.; requiring that the Department of Health
    4         adopt and enforce rules requiring every newborn in
    5         this state to be tested for severe combined
    6         immunodeficiency disease; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsection (2) of section 383.14, Florida
   11  Statutes, is amended to read:
   12         383.14 Screening for metabolic disorders, other hereditary
   13  and congenital disorders, and environmental risk factors.—
   14         (2) RULES.—After consultation with the Genetics and Newborn
   15  Screening Advisory Council, the department shall adopt and
   16  enforce rules requiring that every newborn in this state shall,
   17  prior to becoming 1 week of age, be subjected to a test for
   18  phenylketonuria, severe combined immunodeficiency disease, and,
   19  at the appropriate age, be tested for such other metabolic
   20  diseases and hereditary or congenital disorders as the
   21  department may deem necessary from time to time. After
   22  consultation with the Office of Early Learning, the department
   23  shall also adopt and enforce rules requiring every newborn in
   24  this state to be screened for environmental risk factors that
   25  place children and their families at risk for increased
   26  morbidity, mortality, and other negative outcomes. The
   27  department shall adopt such additional rules as are found
   28  necessary for the administration of this section and s. 383.145,
   29  including rules providing definitions of terms, rules relating
   30  to the methods used and time or times for testing as accepted
   31  medical practice indicates, rules relating to charging and
   32  collecting fees for the administration of the newborn screening
   33  program authorized by this section, rules for processing
   34  requests and releasing test and screening results, and rules
   35  requiring mandatory reporting of the results of tests and
   36  screenings for these conditions to the department.
   37         Section 2. This act shall take effect July 1, 2012.
