HOUSE CONCURRENT
RESOLUTION
URging the Board of Education to hasten its efforts to adopt administrative rules TO ENABLE THE IMPLEMENTATION OF THE LAW GOVERNING CHARTER SCHOOLS.
WHEREAS, in 2009, Senate Concurrent Resolution No. 84 requested the State Auditor to conduct an immediate financial statement audit of Waters of Life Public Charter School for fiscal years 2006-2007 and 2007-2008; and
WHEREAS, the State Auditor conducted preliminary research and engaged in discussion with the Charter School Administrative Office and the independent auditor previously hired to conduct the financial statement audit of Waters of Life Public Charter School for fiscal year 2005-2006, and concluded that there is little to be gained from the procurement of another contractor to conduct financial statement audits of the school because the school's records are largely missing and cannot be recreated; and
WHEREAS, in June 2009, the Charter School Review Panel revoked Waters of Life Public Charter School's charter, citing ongoing problems and deficiencies, a historical pattern of financial instability and poor fiscal management, and chronic issues with inadequate school facilities; and
WHEREAS, on July 31, 2009, the Circuit Court of the Third Circuit issued a permanent injunction preventing the Charter School Review Panel from revoking the school's charter absent the Board of Education's adoption of administrative rules governing the revocation of the charter of a public charter school, thereby preventing any further action by the Charter School Review Panel to revoke the charter of a public charter school; and
WHEREAS, the State Auditor concluded that the Charter School Review Panel's revocation of the school's charter rendered the requested audits moot, and further concluded that the Circuit Court's issuance of a permanent injunction further negated the need for the audits requested by Senate Concurrent Resolution No. 84; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the Senate concurring, that the Board of Education is urged to accelerate its efforts to adopt administrative rules to enable the implementation of the charter school law, including the procedure relating to revoking the charter of a public charter school; and
BE IT FURTHER RESOLVED that after administrative rules are adopted, the Board of Education and the Charter School Review Panel are urged to take action to hold Waters of Life Public Charter School accountable for the school's expenditure of state funds and the quality of education offered by the school including the procedure relating to revoking the charter of a public charter school; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, the Superintendent of Education, the Chairperson of the Board of Education, the Executive Director of the Charter School Administrative Office, the Chair of the Charter School Review Panel, and the Director of Waters of Life Public Charter School.
