A BILL FOR AN ACT

 

 

RELATING TO the Waikiki-Diamond Head Shoreline fisheries management area.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Spearfishing is an ancient method of fishing that has been used throughout the world for millennia.  Early civilizations were familiar with the custom of spearing fish from rivers and streams using sharpened sticks.  Today modern spearfishing makes use of elastic-powered spearguns and slings or pneumatic spearguns to strike the hunted fish.  Specialized techniques and equipment have been developed for various types of aquatic environments and target fish.

     The legislature finds that the Waikiki-Diamond Head shoreline is a popular area for spearfishing.  As a result, there is widespread and serious damage to the coral reefs in the area.

     The purpose of this Act is to prohibit spearfishing at all hours of the day within the Waikiki-Diamond Head shoreline fisheries management area until such time as the department of land and natural resources determines through research that the damage existing as of January 1, 2016, to the coral reefs has abated and the reefs are fully restored.

     SECTION 2.  Chapter 188, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§188-    Waikiki-Diamond Head shoreline fisheries management area; spearfishing prohibited.  (a)  Spearfishing is prohibited at all hours of the day within the Waikiki-Diamond Head shoreline fisheries management area, as defined by the administrative rules of the department of land and natural resources, until such time as the department determines through research that the damage existing as of January 1, 2016, to the coral reefs has abated and the reefs are fully restored.

     (b)  Pole fishing, hook and line fishing, hand net, and thrownet fishing shall be permitted in accordance with administrative rules of the department of land and natural resources.

     (c)  As used in this section:

     "Hawaiian sling" means a fishing device that uses potential energy stored in an elastic or rubber band to launch a spear.

     "Spearfishing" means fishing by the use of a speargun, polespear or handspear, Hawaiian sling, elastic-powered speargun and sling, pneumatic speargun, or mechanically powered speargun."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2016.
