A BILL FOR AN ACT
RELATING TO THE OFFICE OF PLANNING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. On September 21, 2009, the legislature held informational briefings to gather information to determine the broad range impacts of potential layoffs within the department of business, economic development, and tourism office of planning, particularly those in the coastal zone management program and land use division. Seven positions within the office of planning were scheduled to be eliminated, including the manager of the coastal zone management program and three of five positions in the land use division.
The informational briefings focused on a number of priority concerns, including the loss of federal funds for mandated coastal zone management program functions, adverse impacts on statutorily-mandated programs, and inadequacies of state representation in land use proceedings as imminent and critical.
The purpose of this Act is to ensure greater stability and self-sufficiency for the office of planning by establishing the planning special fund for the operations of the office of planning, including personnel costs.
SECTION 2. Chapter 225M, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§225M- Planning special fund. (a) There is established in the state treasury the planning special fund, into which shall be deposited:
(1) Appropriations by the legislature;
(2) Federal funds granted by Congress or executive order; and
(3) Interest, grants, donations, and contributions from private or public sources.
(b) Moneys in the fund shall be used for the operations of the office of planning, including personnel costs of staff positions existing on November 1, 2009; provided that the use of moneys from the fund for current and future personnel costs shall be limited to those employees performing specialized duties necessary to meet the statutory and federal mandates of programs within the office of planning."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.
