A BILL FOR AN ACT

 

 

RELATING TO RENEWABLE ENERGY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 269, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§269-    Generating island electric credit.  (a)  For each eligible residential electric meter on a generating island that is in operation as of December 31 of a calendar year, a generating island electric credit shall be earned, as calculated in subsection (b).  For each month during the following calendar year, each eligible residential electric meter that earned the credit for the preceding calendar year shall receive a reduction of the residential electric bill generated by the eligible residential electric meter, representing a percentage deduction to the residential electric bill equal to the credit earned for the preceding calendar year. 

     (b)  For each generating island, the credit shall be a ratio, expressed as a percentage, in which the numerator is the electric energy consumed by a consuming island that is exported from the generating island by a renewable electric energy producer on the generating island for that calendar year, and the denominator is the total electric energy consumed by the consuming island for that calendar year.  For purposes of this calculation, each exporting electric energy producer's contribution to each consuming island's consumption shall be calculated separately, and the final credit for each generating island shall be an aggregate of all such calculations.

     (c)  The credit shall be paid by the public utility servicing the consuming island.  The public utilities commission, by rule or decision, shall establish the process and procedure for issuance of the credit to eligible residential electric meters.

     (d)  For purposes of this section:

     "Consume" means actual use of electric energy, and may be computed as electricity generation, plus imports, minus exports, minus transmission and distribution losses. 

     "Consuming island" means an island with a population over ten thousand that receives electric energy which is exported from one or more generating islands.

     "Eligible residential electric meter" means an electric meter that measures the amount of electricity used each month by a residential dwelling that consumes less electricity than 100 kilowatt-hours per month; provided that an electric meter that services more than one residential dwelling, such as a single, shared meter for a multi-family dwelling, is deemed an eligible residential electric meter, but the credit shall be subject to proration as provided in this subsection.

     "Exporting electric energy producer" means a person, corporation, trust, partnership, or other entity that uses renewable energy to produce more than two megawatts of electric energy per month and which exports such electric energy to a consuming island from a generating island.

     "Generating island" means an island with a population under ten thousand on which an exporting electric energy producer generates electric energy and exports the electric energy to a consuming island.

     "Renewable energy" shall have the same meaning as defined in section 269-91.

     "Residential electric meter bill" means the monthly invoice generated by the public utility servicing the eligible residential electric meter; provided that, in the case of an eligible electric meter that services more than one residential dwelling, such as a single, shared meter for a multi-family dwelling, the total residential electric meter bill that is eligible for the generating island electric credit shall be the prorated amount of the invoice equivalent to the number of dwelling units using the meter multiplied by 100 kW hours per month."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
