A BILL FOR AN ACT

 

 

RELATING TO THE KAIWI COAST.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the lands of the Kaiwi coast are an invaluable natural asset for the people of Hawaii.  Numerous community members and organizations have fought long and hard over many decades to protect and preserve this unspoiled area for future generations.

     The legislature further finds that a growing interest in this area of Oahu has brought a rapid increase in visitors to the Kaiwi coast.  Without proper management, the area will inevitably become overrun by invasive species and commercial interests or become subject to future development.

     Collaboration between community organizations and government agencies is necessary to address myriad issues, such as managing human impacts, preventing invasive species, and restoring the Wawamalu dune system.

     Therefore, the purpose of this Act is to protect and preserve the lands of the Kaiwi coast in perpetuity by establishing the Kaiwi coast state park for the benefit of residents and future generations.

     SECTION 2.  (a)  The following lands spanning Wawamalu to Makapuu, identified by tax map key numbers, may be transferred to the department of land and natural resources:

     (1)  A portion of (1)3-9-10:003 located makai of Kalanianaole highway and terminating at the eastern access road ingress and egress for Sandy beach park trending southerly to (1)3-9-12:002;

     (2)  A portion of (1)3-9-12:002 located makai of Kalanianaole highway and makai of (1)3-9-10:003 starting at Kaiwi state scenic shoreline and terminating at eastern access road ingress and egress for Sandy beach park trending southerly to the shoreline; and

     (3)  (1)3-9-15:020.

     The following tax map key members, which are located within the Kaiwi state scenic shoreline, may be designated as a state park under the name "Kaiwi coast state park":

     (1)  (1)3-9-11:002; and

     (2)  (1)3-9-11:007.

     The department of land and natural resources shall administer the lands pursuant to this section.

     (b)  All land within or added to the Kaiwi coast state park shall be considered for designation as conservation land.

     (c)  Land in the Kaiwi coast state park shall, in perpetuity, be preserved primarily in its wild and natural state.

     (d)  Any land subsequently added to the Kaiwi coast state park shall be subject to the provisions established in this Act.

     (e)  This Act shall be exempt from the requirements of section 171‑64.7, Hawaii Revised Statutes, and the boundary amendment requirements of chapter 205, Hawaii Revised Statutes.

     SECTION 3.  The following positions shall be established within the department of land and natural resources to support proper land and parks management:

     (1)  One full-time equivalent (1.0 FTE) park caretaker III;

     (2)  One full-time equivalent (1.0 FTE) interpretive tech;

     (3)  One full-time equivalent (1.0 FTE) property manager V; and

     (4)  One full-time equivalent (1.0 FTE) general laborer position.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for the design, construction, planning, and establishment of the Kaiwi coast state park; provided that the planning and establishment shall:

     (1)  Build upon and reflect the direction of recent work for the Maunalua-Makapuu scenic byway and Kaiwi coast master plans; and

     (2)  Coordinate with the Maunalua-Makapuu scenic byway and Kaiwi coast working group established by Senate Concurrent Resolution 190, Regular Session of 2021, and include stakeholders who assisted in the creation of the Maunalua-Makapuu scenic byway and Kaiwi coast master plans and other local community members who are dedicated to the preservation of the lands of the Kaiwi coast.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2050.

Authorizes the transfer of lands to the Department of Land and Natural Resources and establishment of that land and adjacent state-owned lands as the Kaiwi Coast State Park.  Establishes positions within the Department of Land and Natural Resources for management of the Kaiwi Coast State Park.  Appropriates funds.  Takes effect 7/1/2050.  (SD1)
