A BILL FOR AN ACT

 

 

RELATING TO PUBLIC SAFETY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  The purpose of this Act is to:

     (1)  Authorize the development of a new Oahu community correctional center; and

     (2)  Appropriate funds for an oversight coordinator position and necessary support staff positions for the Hawaii correctional system oversight commission, as authorized by section 353L-2, Hawaii Revised Statutes, for the fiscal biennium.

PART II

     SECTION 2.  (a)  The department of public safety shall develop a new Oahu community correctional center in accordance with section 26-14.6, Hawaii Revised Statutes.  The development may be phased to allow for the development of a new Oahu community correctional facility and a new mental health facility.

     (b)  The department of public safety shall not transfer the operations of any new Oahu community correctional center to a corporation as defined by section 414-3.

     (c)  The department of public safety shall provide programming focused on cultural-based rehabilitation at any new facility.

     (d)  The department of public safety's plans and designs shall require input from the Hawaii correctional system oversight commission in regard to best practices about the overall size of the facility, capacity of the facility, and integration of features and inclusion of programming aimed at addressing physical and mental health needs, preventing recidivism, and supporting successful reentry into the community.

PART III

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2021-2022 and the same sum or so much thereof as may be necessary for fiscal year 2022-2023 for an oversight coordinator position and necessary support staff positions for the Hawaii correctional system oversight commission, as authorized by section 353L-2, Hawaii Revised Statutes.

     The sums appropriated shall be expended by the department of the attorney general for the purposes of this part.

PART IV

     SECTION 3.  This Act shall take effect on May 6, 2137.
