Section
1.
NURSING
FACILITY
MEDICAID
REIMBURSEMENT
RATE

RELEASE.
Notwithstanding
any
provision
of
law
to
the
contrary,
2
the
department
of
human
services
may
release
nursing
facility
3
rates
prior
to
receiving
approval
of
a
state
plan
amendment
4
from
the
centers
for
Medicare
and
Medicaid
services
of
the
5
United
States
department
of
health
and
human
services
(CMS)
6
to
reduce
retrospective
rate
processing.
The
department
may
7
retroactively
adjust
or
modify
nursing
facility
rates
released
8
prior
to
receipt
of
federal
approval
and
may
retroactively
9
reconcile
payments
based
on
such
rates
as
necessary
to
reflect
10
any
differences
between
the
rates
submitted
and
the
rates
11
actually
approved
by
CMS
and
to
align
the
rates
with
available
12
funding.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
authorizes
the
department
of
human
services
(DHS)
17
to
release
nursing
facility
rates
prior
to
receiving
approval
18
of
a
state
plan
amendment
from
the
centers
for
Medicare
and
19
Medicaid
services
of
the
United
States
department
of
health
and
20
human
services
(CMS)
to
reduce
retrospective
rate
processing.

The
bill
also
authorizes
DHS
to
retroactively

nursing
22
facility
rates
released
prior
to
receipt
of
federal

and
to
retroactively
