S.F. 322 Section 1. SHORT TITLE. This Act shall be known and may be 1 cited as the “Education Savings Account Transparency Act”. 2 Sec. 2. Section 257.11B, subsection 3, as enacted by 2023 3 Iowa Acts, House File 68, section 7, is amended by adding the 4 following new paragraph: 5 NEW PARAGRAPH . 0b. As part of the application, the parent 6 or guardian shall provide information regarding household 7 income, household size, race and ethnicity of the pupil, 8 disability status, and whether the pupil has an individual 9 education program. The department of education or third-party 10 entity shall anonymize, summarize, and report such application 11 information annually to the general assembly by December 1 12 along with all of the following: 13 (1) Household income, household size, race and ethnicity, 14 disability status, and individual education plan status of the 15 pupil receiving the education savings account payment. 16 (2) Geographic and district of residence data for the pupil 17 receiving the education savings account payment. 18 (3) Education type and location for the pupil for the school 19 year preceding the year receiving the education savings account 20 payment. 21 (4) A categorized list of all reasons for recipient 22 withdrawals or expulsions from nonpublic schools occurring 23 prior to the conclusion of the nonpublic school’s required 24 attendance period. Each nonpublic school shall report to the 25 department of education or third-party entity the reasons 26 for a pupil’s withdrawal or expulsion within ten days of the 27 occurrence. 28 (5) Each nonpublic school’s tuition and fees at each 29 grade level and such amounts for the preceding two school 30 years. Each nonpublic school shall annually report to the 31 department of education or third-party entity the tuition and 32 fee information described in this subparagraph. 33 (6) An annual summary of the qualified educational 34 expenditures by education savings account recipients. S.F. 322 thirty days following the conclusion of the school year for 1 which an education savings account payment was received, the 2 parent or guardian shall file with the department of education 3 or third-party entity a statement that includes each nonpublic 4 school the pupil attended and an itemized list of all qualified 5 educational expenses paid for the child during the school year 6 using education savings account funds. 7 (7) All audits conducted by the department of education or 8 other state agency, or a third-party entity. 9 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 10 importance, takes effect upon enactment. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 2023 Iowa Acts, House File 68, established the education 15 savings account program under Code section 257.11B to provide 16 education savings account payments to qualified pupils 17 attending nonpublic schools for the payment of qualified 18 educational expenses. This bill requires, as part of the 19 application, the parent or guardian to provide information 20 regarding household income, household size, race and ethnicity 21 of the pupil, disability status, and whether the pupil has an 22 individual education program. The department of education or 23 third-party entity administering the program shall anonymize, 24 summarize, and report such information annually to the general 25 assembly by December 1 along with other information required in 26 the bill relating to demographic and educational information 27 of education savings account recipients, reasons for student 28 withdrawals or expulsions during the school year, audits 29 conducted related to the program, and nonpublic school tuition 30 and fee information and qualified educational expenditure 31 information, as required to be reported in the bill. 32 The bill takes effect upon enactment. 33 -2- LSB 2058XS (6) 90 md/jh 2/ 2
