Bill Title: Amends the Department of Central Management Services Law of the Civil Administrative Code of the Illinois. Provides that each municipality receiving or using State funds, either partially or fully, for the purposes of municipal projects shall adopt an ordinance or resolution creating diversity and inclusion requirements and goals for all municipal projects of that municipality. Provides that the diversity and inclusion requirements and goals shall, to the extent possible, be no less restrictive than the diversity requirements and goals provided under the Business Enterprise for Minorities, Women, and Persons with Disabilities Act. Provides that for each municipal project funded, either partially or fully, by State funds, the municipality receiving such funds shall submit a diversity and inclusion report to the Department of Central Management Services. Provides that each municipality adopting diversity and inclusion requirements and goals shall also submit an annual report to the Department. Provides for the contents of the reports. Provides for the adoption of rules.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:

4 | Section 5. The Department of Central Management Services | ||||||
5 | Law of the
Civil Administrative Code of Illinois is amended by | ||||||
6 | adding Section 405-535 as follows:

7 | (20 ILCS 405/405-535 new) | ||||||
8 | Sec. 405-535. Municipal diversity and inclusion | ||||||
9 | requirements; reports. | ||||||
10 | (a) Beginning as soon as practicable after the effective | ||||||
11 | date of this amendatory Act of the 102nd General Assembly, | ||||||
12 | each municipality receiving or using State funds, either | ||||||
13 | partially or fully, for the purposes of municipal projects | ||||||
14 | shall adopt an ordinance or resolution creating diversity and | ||||||
15 | inclusion requirements and goals for all municipal projects of | ||||||
16 | that municipality. The diversity and inclusion requirements | ||||||
17 | and goals required under this Section shall, to the extent | ||||||
18 | possible, be no less restrictive than the diversity | ||||||
19 | requirements and goals provided under the Business Enterprise | ||||||
20 | for Minorities, Women, and Persons with Disabilities Act. | ||||||
21 | (b) For each municipal project funded, either partially or | ||||||
22 | fully, by State funds, the municipality receiving such funds | ||||||
23 | shall submit a diversity and inclusion report to the |

1 | Department. The report shall detail (i) the municipality's | ||||||
2 | success in meeting its diversity and inclusion requirements | ||||||
3 | and goals for the project, (ii) a summary of the number of | ||||||
4 | diverse personnel and contractors employed on the project, and | ||||||
5 | (iii) any other relevant information as may be prescribed by | ||||||
6 | the Department. | ||||||
7 | (c) Each municipality adopting diversity and inclusion | ||||||
8 | requirements and goals under subsection (a) shall also submit | ||||||
9 | an annual report to the Department. The annual report shall | ||||||
10 | detail (i) the diversity and inclusion requirements and goals | ||||||
11 | implemented by the municipality, (ii) information and data on | ||||||
12 | diversity goals, and progress toward and plans for achieving | ||||||
13 | those goals, and (iii) any other relevant information as may | ||||||
14 | be prescribed by the Department. | ||||||
15 | (d) The Department shall adopt all rules necessary for the | ||||||
16 | implementation of this Section.
