1 AN ACT concerning property.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. Return of real property. Upon the payment of the
5sum of $10 to the State of Illinois, and subject to the
6conditions set forth in Sections 10, 15, and 20 of this Act,
7the Director of Natural Resources is authorized to return the
8land referred to as the Wildlife Prairie State Park including
9that real property that was initially conveyed to the State of
10Illinois from the Forest Park Foundation by a corporate special
11warranty deed executed September 5, 2000 and by a warranty deed
12executed on September 4, 2001, by conveying by quitclaim deed
13all right, title, and interest in and to the following
14described land in Peoria County, Illinois (referred to
15hereafter as "Wildlife Prairie State Park") to the Forest Park
16Foundation, a not-for-profit Illinois corporation (referred to
17hereafter as "Forest Park Foundation"):
18 Tract 1: Part of the Northeast Quarter of the Northeast
19 Quarter of Section 30, Township 9 North, Range 7 East of
20 the Fourth Principal Meridian, more particularly bounded
21 and described as follows, to-wit: From the Southeast corner

2Park Foundation.
3 (a) Any conveyance made pursuant to Section 5 of this Act
4shall include the conveyance and transfer to the Forest Park
5Foundation of all right, title, and interest in the tools,
6vehicles, computers, records, equipment, supplies, animals,
7furniture, fixtures, and any other personal property owned by
8the State of Illinois and utilized in operation and management
9of Wildlife Prairie State Park that the Director of the
10Department of Central Management Services determines are not
11needed and cannot be used by any State agency pursuant to
12subsection (b) of this Section.
13 (b) Within 30 calendar days after the effective date of
14this Act, the Department of Natural Resources shall provide the
15Director of the Department of Central Management Services with
16an inventory of all property eligible to be transferred under
17this Section. Within 30 calendar days after the receipt of the
18inventory, the Director of the Department of Central Management
19Services shall determine whether the items in the inventory are
20needed or can be used by a State agency and shall provide his
21or her determination in writing to the Department of Natural
22Resources.
23 Section 15. Agreement. Prior to the return by conveyance of
24any real property to the Forest Park Foundation, the Director
25of Natural Resources shall enter into an agreement with the

1Forest Park Foundation and with the Friends of Wildlife Prairie
2State Park, a not-for-profit Illinois corporation, the
3intended subsequent owner or operator of the property to be
4returned to the Forest Park Foundation, that includes, but is
5not limited to, provisions that serve the following purposes:
6 (1) ensuring that the property returned to the Forest
7 Park Foundation shall in perpetuity be used for
8 educational, conservation, scientific, Illinois historic
9 preservation, and public park purposes, and the promotion
10 of natural resources, including the propagation of wild
11 plants and flowers and domestic and wild animals; and
12 (2) providing, that lodging, resort, recreational
13 facilities, and other commercial purposes, shall be
14 allowable if, and only if, consistent and in furtherance of
15 the public purpose uses described in item 1 of this
16 Section; and
17 (3) requires the Forest Park Foundation to transfer
18 Wildlife Prairie State Park and all personal property
19 transferred pursuant to Section 10 of this Act to Friends
20 of Wildlife Prairie State Park.
21 Section 20. Recording. The Director of Natural Resources
22shall obtain a certified copy of the portion of this Act
23containing the title, enacting clause, the effective date, and
24Section 5 which contains the land description of the property
25to be transferred or otherwise affected under this Act within

169 days after the execution of the agreement specified in
2Section 15 and, upon receipt of payment required by the Section
35, shall record the certified document in the recorder's office
4in the county in which the land is located.
5 Section 25. Return of real property. Upon the payment of
6the sum of $10 to the State of Illinois, and subject to the
7conditions set forth in Section 30 of this Act, the Director of
8Natural Resources is authorized to return the land that was
9initially conveyed to the State of Illinois from the Pleasure
10Driveway and Park District of Peoria by a warranty deed
11executed on May 14, 2003, by conveying by quitclaim deed all
12right, title, and interest in and to the following described
13land in Peoria County, Illinois to the Pleasure Driveway and
14Park District of Peoria:

13required by the Section 25, shall record the certified document
14in the recorder's office in the county in which the land is
