Bill Title: Provides that, to the extent allowed by federal law, uncontaminated plastics that have been processed into a feedstock meeting feedstock specifications for a plastics gasification facility or plastics pyrolysis facility, and that are further processed by such a facility and returned to the economic mainstream in the form of raw materials or products, are considered recycled and are not subject to regulation as waste. Provides that the Environmental Protection Agency may propose to the Pollution Control Board for adoption, and the Board may adopt, rules establishing standards for materials accepted as feedstocks by plastics gasification facilities and plastics pyrolysis facilities, rules establishing standards for the management of feedstocks at plastics gasification facilities and plastics pyrolysis facilities, and any other rules, as may be necessary to implement and administer the amendatory Act's provisions.

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5adding Section 22.59 as follows:
6 (415 ILCS 5/22.59 new)
7 Sec. 22.59. Pilot project for Will County and Grundy County
8pyrolysis or gasification facility.
9 (a) As used in this Section:
10 "Plastics" means polystyrene or any other synthetic
11organic polymer that can be molded into shape under heat and
12pressure and then set into a rigid or slightly elastic form.
13 "Plastics gasification facility" means a manufacturing
14facility that:
15 (1) receives only uncontaminated plastics that have
16 been processed prior to receipt at the facility into a
17 feedstock meeting the facility's specifications for a
18 gasification feedstock; and
19 (2) uses heat in an oxygen-deficient atmosphere to
20 process the feedstock into fuels, chemicals, or chemical
21 feedstocks that are returned to the economic mainstream in
22 the form of raw materials or products.
23 "Plastics pyrolysis facility" means a manufacturing

1facility that:
2 (1) receives only uncontaminated plastics that have
3 been processed prior to receipt at the facility into a
4 feedstock meeting the facility's specifications for a
5 pyrolysis feedstock; and
6 (2) uses heat in the absence of oxygen to process the
7 uncontaminated plastics into fuels, chemicals, or chemical
8 feedstocks that are returned to the economic mainstream in
9 the form of raw materials or products.
10 (b) Provided that permitting and construction has
11commenced prior to July 1, 2025, a pilot project allowing for a
12pyrolysis or gasification facility in accordance with this
13Section is permitted for a locally zoned and approved site in
14either Will County or Grundy County.
15 (c) To the extent allowed by federal law, uncontaminated
16plastics that have been processed into a feedstock meeting
17feedstock specifications for a plastics gasification facility
18or plastics pyrolysis facility, and that are further processed
19by such a facility and returned to the economic mainstream in
20the form of raw materials or products, are considered recycled
21and are not subject to regulation as waste.
22 (d) The Agency may propose to the Board for adoption, and
23the Board may adopt, rules establishing standards for materials
24accepted as feedstocks by plastics gasification facilities and
25plastics pyrolysis facilities, rules establishing standards
26for the management of feedstocks at plastics gasification

1facilities and plastics pyrolysis facilities, and any other
2rules, as may be necessary to implement and administer this
3Section.
4 (e) If permitting and construction for the pilot project
5under subsection (b) has not commenced by July 1, 2025, this
6Section is repealed.
7 Section 99. Effective date. This Act takes effect July 1,
