Bill Title: Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois in the provision concerning advance directive information. Provides that the Department of Public Health shall publish the Department of Public Health Uniform DNR Advance Directive form in Spanish and that the form shall meet the minimum requirements to nationally be considered a physician orders for life-sustaining treatment form. Makes other changes.

1 | AN ACT concerning State government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Department of Public Health Powers and | ||||||
5 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||
6 | amended by changing Section 2310-600 as follows:
| ||||||
7 | (20 ILCS 2310/2310-600)
| ||||||
8 | Sec. 2310-600. Advance directive information.
| ||||||
9 | (a) The Department of Public Health shall prepare and | ||||||
10 | publish the summary of
advance directives law in Illinois that | ||||||
11 | is required by the federal Patient
Self-Determination Act. | ||||||
12 | Publication may be limited to the World Wide Web.
| ||||||
13 | (b) The Department of Public Health shall adopt, by rule, | ||||||
14 | and publish
Spanish language
versions of the following:

15 | (1) The statutory Living Will Declaration form.
| ||||||
16 | (2) The Illinois Statutory Short Form Power of Attorney | ||||||
17 | for Health Care.
| ||||||
18 | (3) The statutory Declaration of Mental Health | ||||||
19 | Treatment Form.
| ||||||
20 | (4) The summary of advance directives law in Illinois.
| ||||||
21 | (5) The Department of Public Health Uniform DNR Advance | ||||||
22 | Directive Any statewide uniform Do Not Resuscitate forms.

23 | Publication may be limited to the World Wide Web.

1 | (b-5) In consultation with a statewide professional | ||||||
2 | organization
representing
physicians licensed to practice | ||||||
3 | medicine in all its branches, statewide
organizations | ||||||
4 | representing nursing homes, registered professional nurses, | ||||||
5 | and emergency medical systems, and a statewide
organization
| ||||||
6 | representing hospitals, the Department of Public Health shall | ||||||
7 | develop and
publish a uniform
form for physician | ||||||
8 | do-not-resuscitate orders that may be utilized in all
settings. | ||||||
9 | The form shall meet the minimum requirements to nationally be | ||||||
10 | considered a physician orders for life-sustaining treatment | ||||||
11 | form, or POLST, and
may be referred to as the Department of | ||||||
12 | Public Health Uniform DNR Advance Directive. This advance | ||||||
13 | directive does not replace a physician's do-not-resuscitate | ||||||
14 | (DNR) order.
| ||||||
15 | (c) (Blank). The Department of Public Health may contract | ||||||
16 | with statewide professional
organizations representing | ||||||
17 | physicians licensed to practice medicine in all
its branches to | ||||||
18 | prepare and publish
materials
required by this Section.
The | ||||||
19 | Department of Public Health may consult with a statewide | ||||||
20 | organization
representing registered professional nurses on | ||||||
21 | preparing materials required by
this Section.
