Bill Title: Amends the Criminal Code of 2012. Provides that a person who intentionally misrepresents an animal as a service animal commits a petty offense. Provides that a person commits intentional misrepresentation of an animal as a service animal when the person: (1) intentionally misrepresents an animal in his or her possession as his or her service animal; (2) was previously given a warning that it is illegal to intentionally misrepresent an animal as a service animal; and (3) knows that the animal is a not a service animal.

720 ILCS 5/48-8.5 new

Amends the Criminal Code of 2012. Provides that a person who intentionally misrepresents an animal as a service animal commits a petty offense. 1 AN ACT concerning criminal law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Criminal Code of 2012 is amended by adding
5Section 48-8.5 as follows:
6 (720 ILCS 5/48-8.5 new)
7 Sec. 48-8.5. Misrepresentation of service animal.
8 (a) A person commits the offense of intentional
9misrepresentation of an animal as a service animal when:
10 (1) the person intentionally misrepresents an animal
11 in his or her possession as his or her service animal, or a
12 person with a disability's service animal whom the person
13 is assisting by controlling, for the purpose of obtaining
14 any of the rights or privileges set forth in State or
15 federal law;
16 (2) the person was previously given a written or verbal
17 warning regarding the fact that it is illegal to
18 intentionally misrepresent an animal as a service animal;
19 and
20 (3) the person knows that the animal is not a service
21 animal.
22 (b) A person who violates this Section commits a petty
23offense.
