Bill Title: Amends the Administration Article of the Illinois Public Aid Code. Provides that, in matters concerning the recovery of overpayments for benefits provided by the Department of Human Services, the Department shall send a recipient written notice and a demand for payment of any amount in overpaid benefits owed within 5 years after the Department's right to collect the overpayment first accrued. Requires the Department to issue such notice by certified mail to the recipient's last known mailing address. Provides that actions for the recovery of overpayments shall be commenced within 10 years after the date the notice was sent.

1 AN ACT concerning civil law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5changing Section 12-12 as follows:
6 (305 ILCS 5/12-12) (from Ch. 23, par. 12-12)
7 Sec. 12-12. Collection of claims; enforcement of penalty
8provisions.
9 (a) The Illinois Department shall pursue the legal
10procedure necessary to collect the claims and enforce the
11penalty provisions provided in any Section or Article of this
12Code relative to applicants and recipients of public aid. The
13Attorney General, at the request of the Illinois Department,
14shall take the necessary proceedings and represent the
15Illinois Department in any matter arising in connection with
16such claims or enforcement of penalty provisions.
17 (b) In matters concerning the recovery of overpayments for
18benefits provided by the Department of Human Services, the
19Department shall send a recipient written notice and a demand
20for payment of any amount in overpaid benefits owed within 5
21years after the Department's right to collect the overpayment
22first accrued. The Department of Human Services shall issue
23such notice by certified mail to the recipient's last known

1mailing address. Actions brought under this subsection by the
2Attorney General for the recovery of overpayments shall be
3commenced within 10 years after the date upon which such
4notice was sent.
