AMENDMENT TO SENATE BILL 1643
2 AMENDMENT NO. ______. Amend Senate Bill 1643, AS AMENDED,
3with reference to page and line numbers of Senate Amendment No.
41, on page 17, by inserting immediately after line 12 the
5following:
6 "(M) An offense involving consensual sexual conduct in
7violation of subsection (c) of Section 11-1.50 of the Criminal
8Code of 2012 is not a sex offense for the purposes of this
9Section if the victim was at least 13 years of age and the
10offender was not more than 4 years older than the victim, and
11the court makes a factual finding that:
12 (1) the sexual conduct was not the result of compulsion
13 or undue influence; and
14 (2) the offender is not a risk of re-offending based
15 on:
16 (A) a risk assessment performed by an evaluator
17 approved by the Sex Offender Management Board;
18 (B) the sex offender history of the offender;

1 (C) information related to the registrant's
2 mental, physical, educational, and social history;
3 (D) victim impact statements; and
4 (E) any other factors deemed relevant by the
5 court."; and
6on page 34, line 25, by inserting "or aggravated criminal
7sexual abuse under subsection (d) of Section 11-1.60" after
8"Section 11-1.50"; and
9on page 37, line 1, by inserting "or aggravated criminal sexual
10abuse under subsection (d) of Section 11-1.60" after "Section
1111-1.50"; and
12on page 37, line 5, by inserting "or aggravated criminal sexual
13abuse under subsection (d) of Section 11-1.60" after "11-1.50".
