Bill Title: Amends the Employment of Teachers Article of the School Code. Provides that educational support personnel employees shall not be required to work on a legal school holiday. Provides that no deduction shall be made from the time or compensation of a school employee, including an educational support personnel employee, on account of any legal or special holiday in which that employee would have otherwise been scheduled to work but for the legal or special holiday (instead of providing that no deduction shall be made from the time or compensation of a school employee on account of any legal or special holiday).

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by changing Section
524-2 as follows:
6 (105 ILCS 5/24-2) (from Ch. 122, par. 24-2)
7 Sec. 24-2. Holidays.
8 (a) Teachers and educational support personnel shall not
9be required to teach on Saturdays, nor, except as provided in
10subsection (b) of this Section, shall teachers, educational
11support personnel, or other school employees, other than
12nonlicensed noncertificated school employees whose presence is
13necessary because of an emergency or for the continued
14operation and maintenance of school facilities or property, be
15required to work on legal school holidays, which are January
161, New Year's Day; the third Monday in January, the Birthday of
17Dr. Martin Luther King, Jr.; February 12, the Birthday of
18President Abraham Lincoln; the first Monday in March (to be
19known as Casimir Pulaski's birthday); Good Friday; the day
20designated as Memorial Day by federal law; June 19, Juneteenth
21National Freedom Day; July 4, Independence Day; the first
22Monday in September, Labor Day; the second Monday in October,
23Columbus Day; November 11, Veterans' Day; the Thursday in

1November commonly called Thanksgiving Day; and December 25,
2Christmas Day. School boards may grant special holidays
3whenever in their judgment such action is advisable. No
4deduction shall be made from the time or compensation of a
5school employee, including educational support personnel, on
6account of any legal or special holiday.
7 (b) A school board or other entity eligible to apply for
8waivers and modifications under Section 2-3.25g of this Code
9is authorized to hold school or schedule teachers' institutes,
10parent-teacher conferences, or staff development on the third
11Monday in January (the Birthday of Dr. Martin Luther King,
12Jr.); February 12 (the Birthday of President Abraham Lincoln);
13the first Monday in March (known as Casimir Pulaski's
14birthday); the second Monday in October (Columbus Day); and
15November 11 (Veterans' Day), provided that:
16 (1) the person or persons honored by the holiday are
17 recognized through instructional activities conducted on
18 that day or, if the day is not used for student attendance,
19 on the first school day preceding or following that day;
20 and
21 (2) the entity that chooses to exercise this authority
22 first holds a public hearing about the proposal. The
23 entity shall provide notice preceding the public hearing
24 to both educators and parents. The notice shall set forth
25 the time, date, and place of the hearing, describe the
26 proposal, and indicate that the entity will take testimony

1 from educators and parents about the proposal.
2 (c) Commemorative holidays, which recognize specified
3patriotic, civic, cultural or historical persons, activities,
4or events, are regular school days. Commemorative holidays
5are: January 17 (the birthday of Muhammad Ali), January 28 (to
6be known as Christa McAuliffe Day and observed as a
7commemoration of space exploration), February 15 (the birthday
8of Susan B. Anthony), March 29 (Viet Nam War Veterans' Day),
9September 11 (September 11th Day of Remembrance), the school
10day immediately preceding Veterans' Day (Korean War Veterans'
11Day), October 1 (Recycling Day), October 7 (Iraq and
12Afghanistan Veterans Remembrance Day), December 7 (Pearl
13Harbor Veterans' Day), and any day so appointed by the
14President or Governor. School boards may establish
15commemorative holidays whenever in their judgment such action
16is advisable. School boards shall include instruction relative
17to commemorated persons, activities, or events on the
18commemorative holiday or at any other time during the school
19year and at any point in the curriculum when such instruction
20may be deemed appropriate. The State Board of Education shall
21prepare and make available to school boards instructional
22materials relative to commemorated persons, activities, or
23events which may be used by school boards in conjunction with
24any instruction provided pursuant to this paragraph.
25 (d) City of Chicago School District 299 shall observe
26March 4 of each year as a commemorative holiday. This holiday

1shall be known as Mayors' Day which shall be a day to
2commemorate and be reminded of the past Chief Executive
3Officers of the City of Chicago, and in particular the late
4Mayor Richard J. Daley and the late Mayor Harold Washington.
5If March 4 falls on a Saturday or Sunday, Mayors' Day shall be
6observed on the following Monday.
7 (e) Notwithstanding any other provision of State law to
8the contrary, November 3, 2020 shall be a State holiday known
9as 2020 General Election Day and shall be observed throughout
10the State pursuant to this amendatory Act of the 101st General
11Assembly. All government offices, with the exception of
12election authorities, shall be closed unless authorized to be
13used as a location for election day services or as a polling
14place.
15 Notwithstanding any other provision of State law to the
16contrary, November 8, 2022 shall be a State holiday known as
172022 General Election Day and shall be observed throughout the
18State under Public Act 102-15.
