Bill Title: Amends the Employment of Teachers Article of the School Code. Provides that educational support personnel employees shall not be required to work on a legal school holiday. Provides that no deduction shall be made from the time or compensation of a school employee, including an educational support personnel employee, on account of any legal or special holiday in which that employee would have otherwise been scheduled to work but for the legal or special holiday (instead of providing that no deduction shall be made from the time or compensation of a school employee on account of any legal or special holiday).

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by changing Section
524-2 as follows:
6 (105 ILCS 5/24-2) (from Ch. 122, par. 24-2)
7 Sec. 24-2. Holidays.
8 (a) Teachers and educational support personnel employees
9shall not be required to teach or otherwise work on Saturdays,
10nor, except as provided in subsection (b) of this Section,
11shall teachers, educational support personnel employees, or
12other school employees, other than noncertificated school
13employees whose presence is necessary because of an emergency
14or for the continued operation and maintenance of school
15facilities or property, be required to work on legal school
16holidays, which are January 1, New Year's Day; the third
17Monday in January, the Birthday of Dr. Martin Luther King,
18Jr.; February 12, the Birthday of President Abraham Lincoln;
19the first Monday in March (to be known as Casimir Pulaski's
20birthday); Good Friday; the day designated as Memorial Day by
21federal law; June 19, Juneteenth National Freedom Day; July 4,
22Independence Day; the first Monday in September, Labor Day;
23the second Monday in October, Columbus Day; November 11,

1Veterans' Day; the Thursday in November commonly called
2Thanksgiving Day; and December 25, Christmas Day. School
3boards may grant special holidays whenever in their judgment
4such action is advisable. No deduction shall be made from the
5time or compensation of a school employee, including an
6educational support personnel employee, on account of any
7legal or special holiday in which that employee would have
8otherwise been scheduled to work but for the legal or special
9holiday.
10 (b) A school board or other entity eligible to apply for
11waivers and modifications under Section 2-3.25g of this Code
12is authorized to hold school or schedule teachers' institutes,
13parent-teacher conferences, or staff development on the third
14Monday in January (the Birthday of Dr. Martin Luther King,
15Jr.); February 12 (the Birthday of President Abraham Lincoln);
16the first Monday in March (known as Casimir Pulaski's
17birthday); the second Monday in October (Columbus Day); and
18November 11 (Veterans' Day), provided that:
19 (1) the person or persons honored by the holiday are
20 recognized through instructional activities conducted on
21 that day or, if the day is not used for student attendance,
22 on the first school day preceding or following that day;
23 and
24 (2) the entity that chooses to exercise this authority
25 first holds a public hearing about the proposal. The
26 entity shall provide notice preceding the public hearing

1 to both educators and parents. The notice shall set forth
2 the time, date, and place of the hearing, describe the
3 proposal, and indicate that the entity will take testimony
4 from educators and parents about the proposal.
5 (c) Commemorative holidays, which recognize specified
6patriotic, civic, cultural or historical persons, activities,
7or events, are regular school days. Commemorative holidays
8are: January 17 (the birthday of Muhammad Ali), January 28 (to
9be known as Christa McAuliffe Day and observed as a
10commemoration of space exploration), February 15 (the birthday
11of Susan B. Anthony), March 29 (Viet Nam War Veterans' Day),
12September 11 (September 11th Day of Remembrance), the school
13day immediately preceding Veterans' Day (Korean War Veterans'
14Day), October 1 (Recycling Day), October 7 (Iraq and
15Afghanistan Veterans Remembrance Day), December 7 (Pearl
16Harbor Veterans' Day), and any day so appointed by the
17President or Governor. School boards may establish
18commemorative holidays whenever in their judgment such action
19is advisable. School boards shall include instruction relative
20to commemorated persons, activities, or events on the
21commemorative holiday or at any other time during the school
22year and at any point in the curriculum when such instruction
23may be deemed appropriate. The State Board of Education shall
24prepare and make available to school boards instructional
25materials relative to commemorated persons, activities, or
26events which may be used by school boards in conjunction with

1any instruction provided pursuant to this paragraph.
2 (d) City of Chicago School District 299 shall observe
3March 4 of each year as a commemorative holiday. This holiday
4shall be known as Mayors' Day which shall be a day to
5commemorate and be reminded of the past Chief Executive
6Officers of the City of Chicago, and in particular the late
7Mayor Richard J. Daley and the late Mayor Harold Washington.
8If March 4 falls on a Saturday or Sunday, Mayors' Day shall be
9observed on the following Monday.
10 (e) Notwithstanding any other provision of State law to
11the contrary, November 3, 2020 shall be a State holiday known
12as 2020 General Election Day and shall be observed throughout
13the State pursuant to this amendatory Act of the 101st General
14Assembly. All government offices, with the exception of
15election authorities, shall be closed unless authorized to be
16used as a location for election day services or as a polling
17place.
18 Notwithstanding any other provision of State law to the
19contrary, November 8, 2022 shall be a State holiday known as
202022 General Election Day and shall be observed throughout the
21State under Public Act 102-15.
