Bill Title: Amends the Election Code. Provides that each petition for nomination shall include an affidavit signed by the candidate, under oath, stating that the petition contains no fewer than the specified minimum number of signatures. Provides that the election authority with whom the petition for nomination would otherwise be filed may not accept for filing any petition for nomination that does not include the affidavit.

1 | AN ACT concerning elections.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Election Code is amended by adding Sections | ||||||
5 | 7-10.4, 8-8.2, and 10-5.2 as follows:

6 | (10 ILCS 5/7-10.4 new) | ||||||
7 | Sec. 7-10.4. Petition for nomination; minimum number of | ||||||
8 | signatures. Each petition for nomination shall include an | ||||||
9 | affidavit signed by the candidate, under oath, stating that the | ||||||
10 | petition contains no fewer than the minimum number of | ||||||
11 | signatures specified in Section 7-10. The State Board of | ||||||
12 | Elections and the various election authorities and local | ||||||
13 | election officials with whom the petition for nomination would | ||||||
14 | otherwise be filed may not accept for filing any petition for | ||||||
15 | nomination that does not include the affidavit required under | ||||||
16 | this Section. The affidavit shall not be deemed to be an | ||||||
17 | affirmation that all of the signatures are valid.

15 | for filing any petition for nomination that does not include | ||||||
16 | the affidavit required under this Section. The affidavit shall | ||||||
17 | not be deemed to be an affirmation that all of the signatures | ||||||
18 | are valid.
