Summary
Amend KRS 315.010 to define "quality assurance program"; amend KRS 315.035 to prohibit the renewal or issuance of pharmacy licenses unless the applicant makes an affirmative statement that a system is in place to identify, evaluate, and respond to medication errors; amend KRS 315.0351 to prohibit the renewal or issuance of pharmacy licenses to out-of-state pharmacies unless the applicant makes an affirmative statement that a system is in place to identify, evaluate, and respond to medication errors; amend KRS 315.121 to clarify that the act of making a medication error does not, without proof of gross negligence or willful disregard for the safety of the patient, constitute unprofessional or unethical conduct for pharmacists and pharmacist interns; create a new section of KRS Chapter 315 to require every pharmacy to establish a quality assurance program that, at a minimum documents medical errors attributable to the pharmacy or its personnel; clarify that documents generated by a quality assurance program are peer review documents not subject to discovery, except by the board of pharmacy or government agencies with jurisdiction over the pharmacy; EFFECTIVE July 1, 2011.
