SENATE BILL No. 85

 

 

January 27, 2009, Introduced by Senator WHITMER and referred to the Committee on Commerce and Tourism.

 

 

 

     A bill to amend 1941 PA 207, entitled

 

"Fire prevention code,"

 

(MCL 29.1 to 29.33) by adding section 3f.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 3f. (1) The state fire marshal may disapprove the

 

unrestricted sale of any novelty lighter if the state fire marshal

 

determines that the device directly or indirectly may cause harm to

 

the public health, safety, or welfare.

 

     (2) The state fire marshal may, as provided in section 2a,

 

promulgate rules to set standards for making the determination

 

described in subsection (1) and may appoint an ad hoc committee to

 

make recommendations regarding the content of the rules.

 

     (3) As used in this section, "novelty lighter" means a device

 

capable of igniting cigarettes or cigars that the state fire

 


marshal determines to have the appearance of a toy, collectible, or

 

other object not generally used as an ignition device.
