A BILL TO BE ENTITLED

AN ACT to modify the conditions upon which the commander of the highway patrol is selected.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 20‑196.3 reads as rewritten:

"§ 20‑196.3.  Who may hold supervisory positions over sworn members of the Patrol.

(a)        Supervision of Patrol Members. – Notwithstanding any other provision of the General Statutes of North Carolina, it shall be unlawful for any person other than the Governor and the Secretary of Crime Control and Public Safety and other than a uniformed member of the North Carolina State Highway Patrol who has met all requirements for employment within the Patrol, including but not limited to completion of the basic Patrol school, to hold any supervisory position over sworn members of the Patrol.

(b)        Commander of the Patrol. – Notwithstanding subsection (a) of this section, the Commander of the State Highway Patrol may be selected from outside the ranks of the Patrol. If the Commander is selected from outside the ranks of the Patrol, then the Commander shall be certified as a law enforcement officer pursuant to the standards established in Chapter 17C of the General Statutes and the rules established by the Criminal Justice Education and Training Standards Commission within 12 months of the date of employment as the Commander."

SECTION 2.  This act is effective when it becomes law.
