A BILL TO BE ENTITLED

AN ACT to authorize the department of transportation to adopt rules allowing individuals who owe civil fines for overweight vehicles to make payment arrangements and to provide notice of those rules.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 20‑118 is amended by adding a new subsection to read:

"(l)        The Secretary of Transportation shall adopt rules governing payment arrangements for penalites assessed pursuant to this section and shall post the rules on the Department's Web site. A citation issued for a violation of this section shall advise the driver to consult the Department's Web site or contact the Department of Transportation to find out if the State will agree to a payment arrangement and, if so, what terms would be applicable."

SECTION 2.  This act becomes effective January 1, 2012, and applies to violations occurring on or after that date.
