A BILL TO BE ENTITLED
AN ACT REQUIRing the JOINT legislative OVERSIGHT COMMITTEE ON JUSTICE AND PUBLIC SAFETY to study whether dual arrest in domestic violence cases should be used by law enforcement agencies.
The General Assembly of North Carolina enacts:
SECTION 1. The Joint Legislative Oversight Committee on Justice and Public Safety shall study the use of dual arrest in cases of domestic violence to determine whether dual arrest should be adopted in North Carolina.
SECTION 2. In conducting the study, the Committee shall consider all of the following:
(1) The State's current laws, rules, or practices relating to domestic violence cases.
(2) What domestic violence cases would be appropriate for law enforcement officers to utilize dual arrest.
(3) What measures should be taken if minor children are present and the law enforcement officer believes dual arrest is necessary.
(4) Any other related issues the Committee deems appropriate.
SECTION 3. The Joint Legislative Oversight Committee on Justice and Public Safety shall submit a final report of its findings and recommendations to the 2019 General Assembly, prior to the convening of the 2020 Regular Session, by filing the report with the President Pro Tempore of the Senate and the Speaker of the House of Representatives.
SECTION 4. This act is effective when it becomes law.
