SYNOPSIS

     Clarifies that county sheriff may simultaneously hold position of emergency management coordinator.

An Act concerning the office of county sheriff and amending N.J.S.40A:9-108.   

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    N.J.S.40A:9-108 is amended to read as follows: 

     40A:9-108.  No person shall hold any other civil office during the time he holds and exercises the office of sheriff and by acceptance of the latter office his former office shall be deemed vacated, provided, however, that the governing body of any county may, by ordinance or resolution, as appropriate, provide that any person holding and exercising the office of sheriff may simultaneously  hold and exercise the office of county [disaster control] emergency management coordinator but shall  not receive any compensation or any other benefits otherwise attached to the  office of county [disaster control] emergency management coordinator during such time as such person shall hold both such offices.

     2.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill clarifies that a county sheriff may simultaneously hold the position of emergency management coordinator under certain circumstances.  Current law permits a county sheriff to simultaneously hold the office of "county disaster control coordinator" provided the sheriff does not receive additional compensation or benefits for holding that office.

     Most statutory references to "disaster control coordinator" were updated to the current phrase "emergency management coordinator" in amendments made to the law in 1989. The reference to "disaster control coordinator" under N.J.S.40A:9-108 is the only remaining statutory reference to that title.  This bill revises the terminology under current law to reflect the updated title, "emergency management coordinator," and bring N.J.S.40A:9-108 in conformity with current statutory law.
