STATE OF NEW YORK ________________________________________________________________________ 9520 IN ASSEMBLY January 23, 2020 ___________ Introduced by M. of A. JOYNER -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to the establishment of obstetric hemorrhage protocols The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (c) of subdivision 1 of section 2803-n of the 2 public health law, as added by a chapter of the laws of 2019, amending 3 the public health law relating to the establishment of obstetric hemor- 4 rhage protocols, as proposed in legislative bills numbers S. 4498-A and 5 A. 6962-A, is amended and a new subdivision 3 is added to read as 6 follows: 7 (c) (i) [The commissioner shall provide guidance to hospitals on8obstetric hemorrhage protocols, in consultation with clinical experts,9and develop or identify an existing toolkit on obstetric hemorrhage10management, which may include a hemorrhage care checklist for use by11hospitals as part of the protocols and guidance on simulation training.12The commissioner shall report to the temporary president of the senate13and the speaker of the assembly on data reported to the department under14this paragraph within two years from the effective date of this para-15graph, and every two years thereafter.16(ii)] The hospital shall adopt, implement[,] and periodically update 17 [and submit to the department] standard protocols for management of 18 obstetric hemorrhage. Such protocols shall address early recognition and 19 assessment[,] and readiness to respond in a multidisciplinary manner[,20and data reporting to the department sufficient for the department to21monitor and report pursuant to this paragraph]. Such protocols shall 22 utilize risk assessment tools such as the toolkit established or identi- 23 fied by the department under [this paragraph] subdivision three of this 24 section and shall include a response plan providing for the triage and 25 transfer to higher level facilities if needed. 26 (ii) The hospital shall maintain and furnish protocols for management 27 of obstetric hemorrhage required pursuant to subparagraph (i) of this 28 paragraph to the department, immediately upon request. The commissioner shall develop guidance to hospitals on obstetric 2 hemorrhage protocols, in consultation with clinical experts, and develop 3 or identify an existing toolkit on obstetric hemorrhage management, 4 which may include a hemorrhage care checklist for use by hospitals as 5 part of the protocols and guidance on simulation training. The commis- 6 sioner shall post the guidance and toolkit on the department's website. 7 § 2. This act shall take effect on the same date and in the same 8 manner as a chapter of the laws of 2019, amending the public health law 9 relating to the establishment of obstetric hemorrhage protocols, as 10 proposed in legislative bills numbers S. 4498-A and A. 6962-A, takes 11 effect.
